Mission Statement
To place much needed emphasis on the strategic enforcement of existing state laws that command safe access to medical marijuana for the sick and infirm.
Since Proposition 215 was voted in by Californians in 1996, the integration of medical marijuana laws into local law enforcement has been largely set aside by elected officials, handed over cautiously to city governing bodies. It is the position of MEDSAC916 that state lawmakers have missed the opportunity to use medical marijuana as a tool to more clearly define themselves in relation to their Federal counterparts - purely as sovereign lawmakers. As uncharted terrain in general, the effective administering of medical marijuana on a local level provides states with all kinds of promising terrain to build new areas of power and influence, especially in the realm of Federal policy where it matters most.

EDDY LEPP EASTER UPDATE
Eddy Lepp Update
San Francisco, CA Mar 23, 2005 -- Charles 'Eddy' Lepp appeared in Federal Court yesterday, a little thinner, but in good spirits, along with co-defendant Daniel Barnes for a status conference.
Judge Marilyn Hall Patel received an ovation for her remarks regarding state's rights and medical cannabis. Eddy even managed to wave to his partner, Linda, and to the twenty people filling the gallery, with a big smile on his face.
Eddy's bail hearing is tentatively scheduled for next Wednesday, March 30, 2005. His current counsel, Omar Figueroa is presently arranging bail for him. More updates to follow...
Demand The Feds Prove Their Legal Jurisdiciton!
Although the general public doesn't know it, the battle over medical-cannabis isnt about marijuana at all!
It's about federal power and federal tax $'s inside the 50 sovereign states.
Our Constitution is very explicit about where Congress enjoys "exclusive legislative", i.e., criminal law enforcement jurisdiction. Guess What?! California is NOT on the list.
At the direct injury of medical marijuana patients, your state government has quietly conspired with the feds to allow them to prosecute Californians for violating federal drug laws, even though such laws are not enforceable insde the state because California has not legally ceded jurisdiction to the feds as is required by 40 USCS 255.
FEDERAL JURISDICTION CHALLENGED!!!
In early 2003, Eddy Lepp, a world known California Med-Pot Activist and Patient, went to the state court (with no attorney) to get back marijuana that had been seized from him by the state CHP during a routine traffic stop. California officials refused to return his lawful property stating that "federal drug laws prevented them from doing so." Lepp motioned the court, bringing ONLY the issue of federal jurisdiciton before the state bench and cited 40 USCS 255.
A few weeks later...a CHP patrol car with two of California's finest appeared in Lepp's driveway to return his cannabis. The case is California Supreme Court, Lake County #CR 31448.01.
A VERY TOUGH QUESTION:
Q: If under US law a state must formally cede criminal jurisdiction to the feds for federally-owned lands (e.g. forts, bases, etc.) under what legal theory does the US government claim federal police authority over non-federal areas within the states?
Jurisdiciton is always assumed, unless Challenged...The People of the Sovereign State of California should demand that both state and federal officials publicly produce the required legal documentation formally establishing federal drug law jurisdicition or immediately halt the prosecution of these federal laws inside California.
ITS TIME FOR THE POPLE TO COMPEL THE DOJ TO ANSWER. YOUR LAWYERS WONT DO IT...

Hey out there, I have a pretty messed up story and hope someone can help asap,
I am unable to help these people, but I am hoping someone out there has a compassionate heart towards their persecution and continued tortureto be able to do something for them. The Brooks family has moved from Grover Beach,ca here to Sac two weeks ago and has had some major trouble getting situated after their arrest on October 18th,2005 for 5 lbs of cannabis and 93 plants. (It was actually only about 8 oz of usable meds-the cops weighed the stems, the containers it was in ect ect ect plus counted the cuttings they were trying to propigate as almost 70 of the 93 plants they are being charged with)In fact, the police illegally entered their home, and after verifying with their doctor that their medical need and right to use and grow cannabis was in fact legitimate. The police ignored this and proceeded to arrest Aileen Brooks, and take away her 5 year old son, Matthew, while husband and father Jason Brooks was in San Francisco listening to the whole thing by cell phone. Aileen had called him just as the police were barging into her home and beat her up in front of their 5 year old son. He raced home only to find that his family had been abducted and his crop stolen by police. They were bailed out and a lawyer hired for them by Hortipharm, a dispensary from Santa Barbara, and are awaiting their preliminary hearing in San Luis Obispo county courthouse on January 24th,2006. Their Son, has been kept from them now almost 3 months just because CPS says that marijuana in their home caused a mortal danger to him and their lack of concern for their child prompted his adbuction.(Even though no evidence of prior abuse has ever been reported and in fact, the Brooks' are wonderfull parents who love their son Matthew and have lovingly cared for him since he was born, and furthermore they know not to feed cannabis to their son, and on top of that, a urine test of Matthew revealed not even a trace amount of THC in his system or other cannebanoids/drugs.) This did not matter to CPS and they have still refused to return him to his parents. Jason & Aileen Brooks have since moved to sacramento, where their son was placed with relatives by CPS, to be closer to Matthew. Unfortunately, they have run into serious financial problems since coming here and are having trouble surviving. Jason accepted a high paying job, which fired him 3 days after he started after learning from a previous employer that he had been arrested and didnt want anything to do with it, no matter what it was about or how illegal the arrest was. Since then, job offers have not been coming in. If there is something that anyone out there can do to help these people, please contact Jason directly at (916) 334-1981, they are currently residing with an old roommate in North Highlands,ca, who, even though didnt have the means , has allowed them to stay in an extra room while they get their son back. Jason has told me that he is not looking for a handout, but a way to earn a living to provide for his family.Jason has 15 years olf professional sales experience and about 4 years of grow experience in hydro ebb/flo setups. Also he has mentioned that his wife's need for her cannabis is quite severe, as Aileen cannot even eat in the morning without access to her cannabis, as her nausea and abdominal pain gets at its worse in the morning and evening, but they have had little to no access to any cannabis since moving here and do not have money to just go to a dispensary and buy the quality of meds she needs to stave off her nausea enough for her to be able to eat and sleep... Maybe someone can help them out with some free meds?? Like I said, I am unable to help with much as my current situation financially is not good but these people REALLY need help from the medical MJ community.
I am praying for them and you all should be to if you cant do more for them. Thanks.

I am looking for information and help. I was involved in a auto accident several months ago and have done all the therepies that Kaiser has offered and my therapist said there is nothing more that can be done physically to help relieve my pain in my back and neck. I have been clean and sober for close to 11 years and I am tired of taking the pills (oxycontin, percocet, vicodin, flexoril and motrin to name a few) for my pain and don't want to be dependant on pills and was told that medical marijuana may be a good alternative to help relax my back and relieve the pain. How do I go about finding a Dr and someone that would fill my prescription for medical purposes since Kaiser does not offer this as an option? Also does the pill form of THC work as well as smoking it? Please reply to mrmike4u2c@yahoo.com Thank you

I also know what you are going through I am an RN who got hurt on the job, I did it all including 11 outpatient surgeries. The pain never goes away and the pain pills (methadone, valium, Norco, oxy IR) were just killing myn liver, I was sleeping 20 hrs a day just trying to escape the pain,check out the side effects of these drugs ( paradoxical anger is one for valium something that is given for spasms, anxiety, seizures. Opiates for pain has a side effect of rebound pain Does this make sence why would you treat a injury or disease with a drug that;s side effects are that which you are trying to treat. After detoxing for 4 wks now off all that crud my pain has decreased I have got sensation to areas I thought had nerve damage to. The first 2 wks were the worst and as a nurse I didnt want to go to the hospital (not recomended you can die) I have lost 28 pounds in 2 weeks 48 in the last 2 months, I have gone from 20 hrs of sleep a day to 30-60 minutes every 2 days, it really sucks . I finally tried canabis. so far eating it and massage with canabis oil helps most. I just got my cannabis license and looking forward to finding a club that dispenses canabis products, but also worried I heard they were raiding the clubs, how does all this work I am overwelmed I have to stay of the pills they were ruining my life but I need something for the pain n/v etc.. To clear the air, it's called a "Doctors'Recommendation". Not a script,because doctors cannot "prescribe" it by federal law,only recommend it for your condition.
Most C0-0ps are on a walk-in basis,but you HAVE to have your recommendation in your hand,and of course a current California drivers license or california ID card.

I live in TN where MJ use is against the law regardless of the reason for use. My eyes were literally coming out of my head when my eye doctor closed the door and told me to use mj daily to reduce the pressure on my eyes. HE could not tell me this in front of anyone and said he would deny if I said he did say it, but he felt that I needed help. It has. How does one get a permission to use it in a state where it is illegal. Is CA the only state? Do you have set up residence there? Please help I do not like breaking the law, lost a great job because of using it, but I like be able to see. Opinions and comments.
